Privacy Policy

This policy covers how Worksmith, Inc. (Worksmith) treats personal information that the company collects and receives, including information related to your past use of Worksmith. Personal information is information about you that is personally identifiable like your name, address, email address, or phone number, and that is not otherwise publicly available. This policy does not apply to the practices of companies that Worksmith does not own or control, or to people that Worksmith does not employ or manage.

Collecting Information
Worksmith collects personal information when you register with Worksmith, when you sign-up for Worksmith subscriptions, when you visit Worksmith pages or the pages of certain Worksmith partners, and when you enter promotions or sweepstakes. Worksmith may combine information about you that we have with information we obtain from business partners or other companies. When you register we ask for information such as your name, email address, birth date, gender, zip code, occupation, industry, and personal interests. Once you register with Worksmith and sign in to our services, you are not anonymous to us. Worksmith automatically receives and records information on our server logs from your browser, including your IP address, Worksmith cookie information, and the page you request. Worksmith uses information for the following general purposes: to customize the content you see, fulfill your requests for products and services, improve our services, contact you, conduct research, and provide anonymous reporting for internal and external clients.

Cookies
Worksmith may set and access Worksmith ‘cookies’ on your computer. Worksmith lets other companies that show advertisements on some of our pages set and access their cookies on your computer. Other companies’ use of their cookies is subject to their own privacy policies, not this one.

Your Information
You can edit your Worksmith account information at any time. We reserve the right to send you certain communications relating to the Worksmith service, such as service announcements, and administrative messages, that are considered part of your Worksmith account, without offering you the opportunity to opt-out of receiving them. You can delete your account by contacting Worksmith.

Confidentiality and Security
We limit access to personal information about you to employees who we believe reasonably need to come into contact with that information to provide products or services to you or in order to do their jobs. We have physical, electronic, and procedural safeguards that comply with federal regulations to protect personal information about you.
Protecting Your Information

Worksmith does not rent, sell, or share personal information about you with other people or nonaffiliated companies except to provide products or services you’ve requested, when we have your permission, or under the following circumstances:
We provide the information to trusted partners who work on behalf of or with Worksmith under confidentiality agreements. These companies may use your personal information to help Worksmith communicate with you about offers from Worksmith and our marketing partners;
We respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims;
We believe it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of Worksmith’s terms of use, or as otherwise required by law;
We transfer information about you if Worksmith is acquired by or merged with another company. In this event, Worksmith will notify you before information about you is transferred and becomes subject to a different privacy policy.

Intellectual Property and Other Proprietary Rights
You may not use Worksmith’s services (the “Services”) in a manner that infringes or misappropriates the rights of a third party in any work protected by intellectual property laws, including, but not limited to, laws applicable to copyrights, trade or service marks, patent rights, or trade secrets. In addition, you may not use our Services in a manner that Worksmith determines has or may be likely to result in a claim of such infringement or misappropriation. For example:
You may not use the Services to download, publish, torrent, distribute, use, or otherwise copy in any manner any text, music, software, art, image, or other work protected by copyright law unless you have permission from the owner of the work to use or copy the work in that manner, or you are otherwise permitted by established intellectual property law to copy or use the work or rights in that manner;
You may not use the Services to publish content intended to assist others in defeating technical copyright protections; and
You may not display another person’s trade or service mark without permission.
In addition, you may not use the Services to publish another person’s trade secrets, or to publish information in violation of a duty of confidentiality. It is ’Worksmith’s policy to terminate the services of customers who engage in any conduct covered by this section in appropriate circumstances.

In addition, in accordance with the Digital Millennium Copyright Act (“DMCA”), Worksmith has adopted and implemented the following notice-and-takedown procedure for copyright owners whose copyrighted work(s) appear on our websites without permission:
Worksmith has designated the “DMCA Agent” below to receive and respond to proper written notifications from copyright owners who claim inappropriate use of copyrighted materials on our websites or through our Services. Should Worksmith’s DMCA Agent receive such a notification in the manner set forth below alleging copyright infringing activity, Worksmith will take whatever action it deems appropriate, in its sole discretion, including removal of the offensive content, contacting the relevant Worksmith account holder, and/or terminating any Worksmith account that is found to repeatedly post infringing content.

All infringement notifications must be submitted in writing to Worksmith’s DMCA Agent at the postal address, and/or email above listed, and must include the following: (1) identification of the copyrighted work(s) claimed to be infringed; (2) identification of the material or link allegedly hosting the infringing content; (3) the copyright owner’s contact information (including mailing address, telephone number, and email address); (4) the following statements: (i) “I hereby state that I have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law,” and (ii) “I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner or am authorized to act on behalf of the owner of the copyright that is allegedly infringed;” and (5) the full name and electronic or physical signature of the copyright owner or the copyright owner’s agent.

Policy Updates
Worksmith may update this policy. We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your Worksmith account or by placing a prominent notice on our site.

Effective Date
This privacy policy is effective as of June 27, 2017.
